MakerPlay Terms of Use

    Last Updated: March 2026

Welcome to MakerPlay. By creating an account or using our services, you (the "Parent" or "Guardian") agree to these Terms of Use. If you do not agree, you may not use the platform.

    1. Eligibility & Parental Responsibility

Age Requirement: You must be at least 18 years old to create an account. MakerPlay is a parent-guided platform.

The Account Holder: You, the Parent, are the sole account holder. You are legally responsible for all activity that occurs under your account, including the actions of any child to whom you grant access via a Child Profile.

Supervision: You agree to supervise your child's use of the platform and to ensure they follow the Community Standards outlined in Section 4.

    2. Registration & Verification

Direct Notice: Upon email/password signup, you must verify your email address to receive our "Direct Notice to Parents." No child data collection occurs until this verification is complete. If you sign up with Apple, Google, or Meta, those providers already verify your email, so we skip email confirmation and show the same Direct Notice in the app before any child profile is created.

Child Profiles: You may create profiles for your children using an age range and a randomly generated username. You agree not to input your child's real name, school, or any other identifying information into any free-text fields.

Verifiable Parental Consent (VPC): Certain features, such as "Public Game Sharing," require full verification via a credit card transaction (subscription fee). This is a legal requirement to ensure an adult has authorized public data disclosure.

    3. AI Coach & Generated Content

AI Interactions: MakerPlay uses Artificial Intelligence to help children build games. You acknowledge that AI-generated content can occasionally be inaccurate or "hallucinate."

Safety Guardrails: Our AI is programmed with strict safety filters. You agree not to attempt to "jailbreak" or bypass these filters to generate inappropriate content.

Data Use: We do not use your child's specific interactions or game code to train third-party AI models. All AI interactions are for the sole purpose of the child's learning experience.

    4. Community Standards (The "Safe Combat" Rule)

To keep MakerPlay safe for everyone, all games and projects must follow these rules:

Allowed: Fantasy or cartoonish combat (e.g., spaceships, jet fighters firing missiles, magic wands, robots).

    Prohibited:

    • Realistic firearms or depictions of real-world military hardware.
    • Graphic violence, realistic blood, or gore.
    • Content that promotes bullying, hate speech, or self-harm.

No PII in Games: You are responsible for ensuring your child does not include their real name or personal details within the text of the games they build.

    5. Intellectual Property

Your Content: You (and your child) own the logic and creative elements of the games you build.

Our License: To run the service, you grant MakerPlay a worldwide, royalty-free license to host, store, and (if you choose to "Publish") display your games to other users.

Remix: When you publish a game, you also grant other MakerPlay users the right to remix it on the platform — meaning they may copy the game, modify it, and publish their own version. Remixed games keep attribution to the original creator (title and username at the time of remix). Remixing does not transfer ownership of your original game.

MakerPlay Assets: The MakerPlay platform, AI Coach characters, and provided art assets remain the property of MakerPlay.

    6. Payments & Subscriptions

Billing: Payments are processed securely via Stripe.

Refunds: Subscriptions can be canceled at any time in the Parent Dashboard. Refunds are handled on a case-by-case basis.

    7. Limitation of Liability

MakerPlay is provided "as is." To the maximum extent permitted by law, MakerPlay shall not be liable for any indirect, incidental, or consequential damages arising from the use of the AI Coach or the platform. We do not guarantee that the platform will be 100% error-free or that the AI will always produce functional code.

    8. Termination

We reserve the right to suspend or terminate any account that violates these terms or poses a safety risk to the community, without prior notice.
